Access and use by users of this site (www.cahramap.com) constitutes acceptance by the user of these Terms and Conditions, which take effect from the date of first use. We may amend the Terms and Conditions at any time by posting the amended terms on this site.

Background

CAHRA Map has been developed by Kumi Consulting Ltd (Kumi) to provide a service to clients in supporting the identification of ‘conflict-affected and high-risk areas’. CAHRA Map provides a service of collecting, collating and interpreting data from multiple publicly available, third party sources for the benefit of clients (users). Grouptree Limited (Grouptree) provides the software application and hosting, as a contracted service provider to Kumi.  

CAHRA Map references third party data that have been made publicly available for the purposes of providing information about potential risks or impacts relating to human rights, governance, conflict or mineral flows. Most of the data sources utilised by CAHRA Map are those that the European Commission encourages companies to review in its guidelines for the identification of conflict-affected and high-risk areas and other supply chain risks under the EU Conflict Minerals Regulation (Commission Recommendation (EU) 2018/1149). Users of CAHRA Map are provided with clear references to all third-party data. 

Service access

Kumi shall use commercially reasonable endeavours to ensure that www.cahramap.com (“the website”) is normally available 24 hours a day, seven days a week, except for maintenance. Kumi will use reasonable endeavours to provide users with 24 hours’ notice of maintenance that may mean the website cannot be accessed by users for a period of 6 hours or more. Access to the website may be suspended temporarily and without notice in the case of system failure, telecommunications issues, maintenance or repair or for any reason beyond Kumi’s control. Neither Kumi or its supplier, Grouptree, will be liable if for any reason the website is unavailable at any time or for any period. 

Subscription access

Payment of subscription monies entitles the authorised user(s) within an organisation to unlimited access to the subscription area of the website via a username and password for the period agreed according to the payment option chosen by the user. 
Should the subscription area be unavailable for an unreasonable period of time (defined as 48 consecutive hours or more) then Kumi may provide, upon request, a pro rata refund of subscription monies paid by the user dependent upon the time that the subscription area is not accessible and the duration of the user’s subscription.

Authorised users

Authorised users are identified at the time of subscription. Only those individuals identified and nominated by the client organisation to be authorised users are entitled to access the subscription area of the website. Each authorised user shall keep a secure, confidential password for their access to the website. Client organisations that have paid for a subscription to CAHRA Map and wish to change the individual who is a nominated user must inform Kumi so that access can be transferred to the new individual. Individuals who are authorised users may not transfer their website access rights to another organisation without another subscription. 

Restrictions on use

All reports accessed and/or downloaded and/or printed from the website may not be distributed, republished, uploaded, posted, or transmitted in any way outside of your organisation, without the prior written consent of Kumi. Restrictions in force by the websites of source information will also apply.

Kumi prohibits the framing of any content available on the website without prior written consent. Kumi reserves the right to disable any unauthorized links or frames and disclaims any responsibility for the content available on any other site reached by links to or from the website.

Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with English law. Any dispute arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of English courts. If any provision of this agreement shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. This document, when taken together with the Privacy Policy, constitutes the entire agreement between the parties relating to the subject matter set out therein.
